Summer R & R in Your Backyard Rules
Who Can Enter
1.Entrants must be Missouri or Illinois residents who are 18 years of age or older, own their dwelling, and live within a 50 mile radius measured via MapQuest (www.mapquest.com) from the KTVI FOX 2 television facilities on 2250 Ball Drive; St. Louis, MO 63146 . If entering with a computer, contestant must have lawful access to the Internet with a valid e-mail address.
2.Employees of Community Television of Missouri LLC (KTVI FOX 2 and KPLR 11), R & R Pools, Building Products, and Kaestner Lawn Care, (collectively,“Sponsors”), and their affiliated companies, advertising and promotion agencies, and the immediate family members of each are ineligible.
How to Enter
3.The Summer R&R in Your Backyard contest (“the Contest”) will begin on Monday, March 21st, 2011 and end on Thursday, June 9th, 2011 at 12:00pm CST. No purchase is necessary to enter or win. Only one entry per household. To participate in the Contest, submit your entry at www.fox2now.com or via U.S. Mail (Summer R&R in Your Backyard contest; KTVI-TV; 2250 Ball Drive; St. Louis, MO 63146). All entries must be received no later than 12:00pm Thursday, June 9th, 2011 and will become the property of Sponsor and will not be returned to the contestant.
4.Entries submitted via www.fox2now.com or thru the mail must include two (2) color photos taken between March 14, 2011 and June 9th, 2011. Eligible photos will include the specific location where you want an in-ground pool and landscaping installed and one photo of homeowners, family or group of individuals who would enjoy the pool if you win. Attached pictures of the location, individual or group must be submitted in a .jpg file attached to the email address listed on the contest page. Mailed pictures must be submitted as 4 x 6 photos. Each entry must also include a creative and/or persuasive essay or story outlining why you want, need or deserve a pool. Essay must not exceed 150 words.
5.Entrants must own or otherwise have the necessary licensing rights to the copyright in the photographs submitted. Each Photographic Entry (“Photo Entry”) must be the original creative work and/or property of the Contestant and must not contain copyrighted materials or any other materials, which may be restricted, prohibited, or outlawed by Federal, state or local laws. Sponsor, at its sole discretion, reserves the right to disqualify and/or request removal of any Photo Entry if such Photo Entry contains illegal, indecent, pornographic, sexually explicit content, or otherwise offensive material such as aberrational behavior, graphic violence or drug abuse, or demean any gender, race, religion, or sexual orientation or if such Entry contains material whose content is deemed at the sole discretion of Sponsor to be unsuitable for public viewing. Sponsor reserves the right to disqualify any entrant based on a claim of copyright infringement, with or without investigation.
6.Entrants must be in compliance of subdivision, city, county, state laws and requirements for installing a pool and landscaping materials. Pool and landscaping prize must only be used for pool location submitted in original photo entry. Each municipality requires permits for remodeling and landscaping requirements, including swimming pools and the installation of such. Each eligible entrant is responsible for obtaining approval from their designated subdivision and/or neighborhood before the installation of the pool at their residence.
7.Each entrant must include name, home address, phone number and birth date. (i) Access the on-line contest entry form on the FOX 2 website at www.fox2now.com and follow all instructions to complete the on-line contest entry form (including your photos) as directed on the website or (ii) mail your essay and photos to Summer R&R in Your Backyard Contest, c/o FOX 2, 2250 Ball Drive, St. Louis, MO 63146 . No mechanically addressed, reproduced, or completed entries will be accepted. In the event of a dispute, Sponsor will deem each e-mail entry to have been submitted by the holder of the e-mail account from which it was sent. All submissions must be original and conform to Sponsor’s then-current standards and practices and policies as established or determined by Sponsor in its sole discretion. Entry constitutes an unlimited perpetual license to Sponsor to use any entry materials, including , but not limited to, the right to copy, distribute, publicly perform and display the entry materials on its websites, television stations and in any and all media whether now known or hereinafter invented. Entry constitutes a warranty that Entrant owns all intellectual property rights in the entry materials, if any. Except where prohibited by law, entry constitutes permission to use winner’s name, hometown, likeness, and photographs for broadcast, online posting, or in any other media, and/or any advertising and publicity without additional compensation. Entries will be destroyed after one year.
8.Sponsor is not responsible for error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or technical, network, telephone equipment, electronic, computer, hardware, or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry, winner or other giveaway information by Sponsor or entrants for any reason whatsoever. Sponsor is also not responsible for any injury or damage to any entrant’s or any other person’s computer related to or resulting from playing or downloading any materials in the giveaway or for entries that are late, misdirected or incomplete. All entries become the property of Sponsor and will not be returned. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE GIVEAWAY IS A VIOLATION OF THE CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right to cancel the giveaway if it becomes technically corrupted.
Selection of Winner
9.Decisions of station management with respect to the Contest are final.
A panel of judges from the Sponsors will review and judge each eligible entry received by the entry deadline. Entries will be judged based upon factors including but not limited to: the creativity of the essay, persuasiveness of the entry, review of photos, and judgment of Sponsor to determine how photos showcase Sponsor’s ability to install a pool and landscaping in the location shown in the photos. Judges may, but are not required, to visit the proposed pool location in person before making a final decision. The decision of judges is final on all matters relating to the selection of the winner. Photos will not be returned. The judges will narrow eligible entries down to the top five (5) contestants on or around June 13, 2011.
The top five (5) entries will then be posted at www.fox2now.com and viewers will be invited to vote for their favorite entry between the dates of Thursday, June 16, 2011 through Thursday, June 23, 2011. Viewers can only cast their vote when they fill out the online form including their name, address, phone number and e-mail address before they will be allowed to vote. Voting is limited to one (1) vote per day per registered email address.
The grand prize winner will be the entry that received the most votes. In the event of a tie, sponsors will select the grand prize winner. Grand prize winner will be announced live on the air on or around June 24, 2011 during FOX 2 News in the Morning between 5am – 10am.
The Prize(s)
10.One grand prize winner will receive a prize package including:
a. Royal Fiberglass Pool – Roman Model (Dimensions 11”10” Wide X 27’6” Long, Depth 3’2” to 5’) with regular install package (Premium Pump & DE Filter, Salt Generator, Hydro-automatic Skimmer, 3 Return Inlets, Vacuum Head with Floating Hose, Hand Wall Brush and Leaf Net, Telescoping Vacuum Pole, Test Kit and Startup Kit, 4’ Concrete Deck on all 4 sides, Rough Grade with Existing Dirt, Basic Electrical, First Winterizing of Pool) and any required building permits as required by state and federal law. R&R Pools grand prize will NOT exceed $27,660.
b.Landscape planting materials and labor provided by Kaestner Lawn Care including but not limited to: shrubbery, perennials, mulch and other necessary landscaping items, plus labor and landscape design layout up to a value of $10,000.
c.Hardscape building materials provided by www.BuildingProductsCorp.com including but not limited to: masonry, cast stone, pavers, brick up to a value of $5,000.
The brands and products provided are up to the Sponsor’s discretion. Pool and landscaping installation will be scheduled to be complete on or around July 22, 2011. Install may however be delayed longer than July 22, 2011, due to weather, natural disasters or delay of materials. Sponsors are not responsible for unforeseen weather, natural disasters or delay of materials. Pool and landscaping prize must only be used for pool location submitted in original photo entry. If winner’s pool location is not the location shown in the submitted entry winning photos, winner will be disqualified and another winner will be awarded.
11.Grand prize winner is solely responsible to pay for any and all additional requirements to complete a pool or landscaping installation not mentioned. These requirements include but are not limited to: permits related to remodeling as outlined by subdivision, city, county, state and federal law, installation of fencing surrounding the pool, landscape materials, additional grading if necessary, sod and seed of yard, removal of tree(s), supplies and installation of required motion lights, gates, locks, ongoing maintenance of the pool, cleaning supplies, chemicals and filters, pool cover(s), and costs related to opening and closing of the pool after the pool is installed, furniture, additional decking or patio materials as required by law and all fees, taxes and surcharges not outlined here.
12.Up to five (5) eligible entrants will be qualified as semi-finalists and notified between June 13th and June 15th, 2011. The entries of the five (5) semi-finalists will then be posted for viewers to vote between June 16th and June 23, 2011. One (1) grand prize winner will be awarded the grand prize and announced on air on or around June 24, 2011 during FOX 2 News at 9:00AM with Tim Ezell. Winner will be required to appear on FOX 2 News at 9:00 AM with Tim Ezell a minimum of two times: upon announcement of prize on or around June 24th, 2011 and again with Tim Ezell when winner hosts a Pool Party upon completion of the pool installation on or around Friday, July 22, 2011.
13.Grand prize winner will be required to complete, sign and return a Certification of Eligibility and Release and a contract with R & R Pools within three days of the date of notification or they will be disqualified. If the grand winner cannot be reached, or if a winner does not return the Certification of Eligibility and Release or the R & R Pools contract within 36 hours, the prize will be awarded to an alternate winner will be awarded. If an alternate winner does not timely return the affidavit of eligibility, the prize will not be awarded.
14.Prizes cannot be redeemed for cash or substituted for any other items by the winner. The winner cannot assign or transfer prize. Sponsor reserves the right to substitute a comparable prize of like or greater value, including cash, for any prize, for any reason. Sponsor reserves right to revise rules without notification at any time.
15.The winner is responsible for all local, county, state, and federal taxes on prizes based on the value of the prizes set forth in these rules.
16.Only one prize will be awarded per household. Individuals are eligible to win only one prize within any 30-day period from Community Television of Missouri LLC (KTVI-TV and KPLR-TV), regardless of the number of giveaways entered. Winner must claim the prize within 36 hours of notification or the prize will be forfeited.
Odds of Winning Miscellaneous
17.Odds of winning depend on the number of entries received.
These giveaway rules are available Monday through Friday during normal business hours (between 8:30 a.m. and 5:00 p.m.) at KTVI FOX 2, Summer R&R in Your Backyard Contest Contest, 2250 Ball Drive; St. Louis, Missouri 63146 through June 23, 2011.
18.For the name of the prize winner, send a separate, self-addressed, stamped envelope after June 23, 2011 to: KTVI FOX 2, Summer R&R In Your Backyard Contest, 2250 Ball Drive; St. Louis, Missouri 63146.
19.This giveaway is subject to all applicable laws and regulations and is void where prohibited or restricted by law, including without limitation, in jurisdictions requiring registration, filing, trust account, or posting of a bond, or any other requirements or disclosures that are not expressly satisfied by these rules. Each municipality requires permits for remodeling including swimming pools and the installation of such. R & R Pools will secure all necessary permits needed to install the pool described previously. Each valid applicant is responsible for obtaining approval from their designated subdivision before the installation of the pool at their residence. If the winner fails to obtain the necessary approval from their respective municipality/subdivision before entering and the dwelling is not zoned for this type of remodeling, the prize shall be forfeited
20.By entering, participants represent that they are eligible, and agree (a) to be bound by these rules and the decisions of the judges, (b) to release Sponsor, KTVI FOX 2, Community Television of Missouri LLC, R & R Pool (collectively, “Sponsor”), their parent, subsidiary, affiliated and related entities, and the officers, directors, employees, licensees and assignees of each from any and all liability for any injuries, losses, or damages of any kind caused by any prize or resulting from acceptance, possession, use, or misuse of any prize, and (c) to Sponsor’s use of participant’s personal information as described in Sponsor’s Privacy Policy located at www.fox2now.com.
