KTVI FOX 2 / LACLEDE GAS “SPARK THE GREEN” SWEEPSTAKES
OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR CLAIM A PRIZE. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. VOID WHERE PROHIBITED OR OTHERWISE RESTRICTED BY LAW.
1. ELIGIBILITY: Beginning January 26, 2010, FOX2NOW.COM is conducting “Spark The Green” Contest (“Sweepstakes”.) Sweepstakes is open only to legal residents of MO and IL who are 18 years of age or older. Void where prohibited by law. Employees of Tribune Broadcasting, Local TV, LLC, KPLR-TV, KTVI-TV and Laclede Gas, each of their parent, subsidiary companies, affiliates, divisions, franchisees, representatives, consultants, sub-contractors, suppliers, distributors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, and their officers, directors, employees, shareholders and agents, and members of such employees’ immediate families (defined for these purposes as including spouse, parents, children, and siblings and each of their respective spouses) and individuals living in the same household with such employees, are not eligible to win. Sweepstakes begins on January 26, 2010 at 12:01AM (CST) and ends April 16, 2010 at 11:59PM (CST), (“Sweepstakes Period”). Times may change subject to broadcast schedule.
2. TO ENTER ONLINE: Log onto www.fox2now.com, Complete the “Spark The Green” entry form by entering name, full mailing address, daytime phone number during the Sweepstakes Period, valid email address, and verification of age by clicking one box: “I am over 18 years old.” Entrant must also describe in 150 words or less, a cost-efficient, energy saving , (or “green”) initiative he/she has implemented in his/her home or work place. Four (4) prizes will be awarded at the end of Sweepstakes Period. Each Winner will receive a $250.00 in Laclede Gas gift certificates. By participating in the Contest, entrant certifies that his/her entry is original, has not been previously published or won any award, and does not contain any material that would violate or infringe upon the rights of any third party, including copyrights, trademark rights, privacy or publicity. Sponsor reserves the right in its sole and unfettered discretion to disqualify any entry that it believes contains obscene, offensive or inappropriate content, that does not comply with these official rules or that is not consistent with the spirit or theme of the contest. Entrant may enter as many different initiatives as he/she wishes.
3. CONDITIONS OF ENTRY: Entrant must use his or her own name. Entries containing attached files, and entries which do not comply with these rules are not eligible and will be rejected. Sponsors are not responsible for lost, incomplete, damaged, illegible, late, or misdirected entries, or for mechanical transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor or presenter on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. ANY ATTEMPT TO DAMAGE OR UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS CONTEST WILL RESULT IN DISQUALIFICATION. Sponsor reserves the right to select winners from eligible entries received as of the termination date. Sponsor further reserves the right to disqualify any individual who tampers with the entry process. Sponsor may prohibit an entrant from participating in a Promotion if it determines that said entrant is attempting to undermine the legitimate operation of the Promotion by cheating, hacking, deception or other unfair playing practices or intending to abuse, threaten or harass other entrants. Any attempt by a participant to deliberately damage any Web site or undermine the legitimate operation of the Promotion is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such participant to the fullest extent of the law. Sweepstakes rules shall be governed and enforced pursuant to Missouri law, excluding choice of law provisions. By entering, entrants agree to release and hold harmless KTVI-TV, KPLR-TV, Tribune Broadcasting, Local TV LLC, the parent, subsidiary companies, affiliates, divisions, franchisees, representatives, consultants, sub-contractors, suppliers, distributors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, and their officers, directors, employees, shareholders and agents, and each of the foregoing entities’ employees, officers, directors, shareholders and agents (collectively the “Released Parties”), from and against any and all claims, actions and/or liability for any injuries or death, loss or damage of any kind arising from or in connection with participation in and/or entry into the Sweepstakes or acceptance, delivery or use of prize. By entering, entrants agree to comply with these Official Rules. In the event of dispute as to who submitted that online entry, the entry will be deemed submitted by the Authorized Account Holder of the email address submitted at the time of entry. “Authorized Account Holder” is defined as the natural person assigned to an email address by an Internet access provider, on-line service provider or other organization responsible for assigning email addresses for the domain associated with the email address in question.
4. PUBLICITY RELEASE: Except where prohibited by law, entry in the Sweepstakes constitutes each entrant’s consent to use, publish, reproduce and for all purposes, including publicity, promotion and advertising, in commerce and all media worldwide (including without limitation, Internet, television or offline promotions), entrant’s name, city of residence, photograph, likeness, voice, image, statements, and descriptions, each in perpetuity without limitation or further compensation, credit or right of review or approval.
5. SELECTION OF WINNER: On or about 9:00AM, April 20, 2010, a panel of judges from the KTVI staff will select one winner, who will be notified by telephone and must respond to such notification within twenty-four (24) hours after the notification or the entrant will be disqualified and an alternate winner may be selected from the remaining eligible entries. Upon prize forfeiture, no compensation will be given.
6. PRIZE: Subject to eligibility verification and compliance with these rules, four (4) Winners will receive a $250.00 in Laclede Gas gift certificates, and their winning ideas will be featured on FOX 2. Certificates must be picked up at the KTVI studios 2250 Ball Drive, St. Louis, MO 63146, by 5:00PM Friday, May 25, 2010. Odds of winning depend upon the number of eligible entries received.
7. RESTRICTIONS: Prize is non-transferable and non-assignable, and may not be redeemed for cash. No prize substitutions; provided, however, that Sponsor reserves the right to substitute a prize of equal or greater value if the prize becomes unavailable for any reason in the sole and complete discretion of Sponsor. All taxes on prize and other expenses related to accepting and/or using the prize are the sole responsibility of Winner. The value of the prize will be taxable to Winner as income. Sponsor shall have no responsibility or obligation to any Winner or potential Winner who is unable or unavailable to accept or utilize prize as described herein. Prize will not be replaced or exchanged if lost or stolen. To be eligible for the prize, the potential Winner must complete an affidavit of eligibility/liability/publicity and release as well as any other documents, which may be required by Sponsor or prize provider. Failure to do so will result in disqualification and the selection of an alternate winner from remaining eligible entries. Upon prize forfeiture, no compensation will be given.
