FOX 2 – Up in the Air / Los Angeles Trip / Sweepstakes Rules

TO ENTER: KTVI-TV FOX 2 (“Sponsor”) is conducting an “Up in the Air” Sweepstakes. The Sweepstakes is open only to legal citizens of the United States who are legal residents of MO and IL, and who are 18 years of age or older as of November 20, 2009. NO PURCHASE NECESSARY. Sweepstakes begins November 20, 2009 on or around 5:00pm CST, and ends on Tuesday, November 24, 2009 on or around 4:00pm (Sweepstakes Period).  Entrants must have lawful access to the Internet with a valid e-mail address.  Employees of KTVI-TV, Local TV, LLC., and their affiliated companies, advertising and promotion agencies, and the immediate family members of each are ineligible.

ONLINE ENTRY: Entrants log on to www.fox2now.com during Sweepstakes Period and click on the “Up in the Air” link on the home page, or click on the Contest page and then the “Up in the Air” link, until reaching the Entry Page. Complete the entire entry form, including name, address, age, telephone number, cell phone number, email address and name of travel companion who will accompany entrant if selected as the winner. Entrant must also agree to be home on Wednesday, November 25, 2009, between 7:00am and 9:00am. No limit on number of entries.

Online entrants will receive a confirmation message of their entry. If an entry is rejected, it immediately will be kicked back to the online entrant, notifying them to resubmit, by filling in all required fields in the entry form. Online entries containing attachments, generated by a script, macro or other automated means shall be disqualified. Online entrants must use their own name. Entries containing mechanical, technical or electronic reproductions, facsimiles or entries containing attached files are not eligible and will be rejected. Restrictions: By entering, entrants agree to be bound by and comply with these Official Rules. Entries that do not will be disqualified. Sponsor is not responsible for lost, incomplete, damaged, illegible, late or misdirected entries, or for errors in mechanical transmission, technical difficulties, faulty internet or telephone service connections, and unavailability of servers, inability to transmit messages or entries, or any other technical malfunctions.

SELECTION OF WINNER: One (1) Winner will be randomly selected from among all eligible entries. Odds of winning depend upon the number of eligible entries received. Sponsor will be the sole and final judge of eligibility, Winner verification and all other matters connected with the Sweepstakes. The Winner will be notified in person.  The Winner must be present at the address provided on his/her entry on Wednesday, November 25, 2009, between 7:00am and 9:00am. CST, in order to receive the prize.  The Winner and traveling companion must both be 18 years of age or over. 

If the Winner is not present at the address provided on the entry form on the date and time above, the prize package will be awarded to an alternate Winner in person (at the address listed on his/her entry form), who will have been selected by random drawing in advance, for up to five alternates.  If a designated Winner is home on the date and time above, but does not complete the affidavit of eligibility, the prize will not be awarded. 

PRIZE: Subject to eligibility verification, One (1) Winner will receive a trip for two (2) to see the premiere of the film “Up in the Air.” Trip includes (a.) Two (2) roundtrip airfare tickets from St. Louis, MO to Los Angeles, CA. departing Sunday, November 29, 2009 and returning Tuesday, December 1, 2009. (b.) Hotel accommodations for two (2) nights (based upon double occupancy.)  (c.) Two (2) tickets to the Los Angeles Premiere Screening and After Party of the film “Up in the Air” on Monday, November 30, 2009. Airport transfers (in Los Angeles only) and Transportation to/from the premiere & after party. Approximate retail value of Prize: $2,500.00. Other than the elements of the prizes specifically described in these rules, the Winner shall be responsible for all other expenses and arrangements connected with the use and redemption of the Prize, including, but not limited to, sightseeing, other entertainment, ground transportation, gratuities and all other incidental expenses incurred by the Winner and his/her travel companion (if any.)

PRIZE RESTRICTIONS: Prize is non-transferable, non-negotiable and not redeemable for cash, credit or merchandise. If prize becomes unavailable for any reason, Sponsor reserves the right to substitute a prize of comparable value. Sweepstake Winner must be able to travel on dates listed in these rules. Unclaimed prize will be forfeited and no alternate winner will be selected. Winner is solely responsible for all taxes and fees associated with prize receipt and/or use. Prize Winner will be notified in person by a representative of KTVI-TV FOX 2, and must sign Prize Winner affidavit at that time. Winner must present valid government issued proof of identification.

CONDITIONS AND RESTRICTIONS: Entrants agree Sponsor have the sole right to decide all matters and disputes arising from this Sweepstakes and that their decision is final and binding. Except where prohibited by law, entrants 18 and older agree to allow use of their name, voice, photograph, likeness and any information provided on entry form, in any medium of communication, including print, Internet, radio and/or television and for any purpose, including advertising, promotional or other purposes, by Sponsors and/or its affiliates, without additional compensation. Winner by acceptance of his/her prize, agrees to release, indemnify and hold harmless Sponsor, their respective parent companies and affiliates, and each of their employees, representatives, contractors, sponsors and advertisers, from any and all liability, loss, damage, costs or claims related to any allegation regarding the award of, the receipt of, or the use of his/her prize. Sponsor is not responsible for personal injury of any Winner or travel companion incurred in connection with the use of the Prize. Winner may be required to execute an affidavit of eligibility and release of liability prior to receiving the Prize. Winner assumes all applicable tax liability for his/her Prize.

ELIGIBILITY: Sweepstakes is not open to employees of Sponsor or their immediate family members, or to employees or immediate family of any of Sponsor’s affiliated companies, licensees, advertising or promotional agencies. Any member of a household that has been awarded a prize in any other contest or sweepstakes offered by KTVI-TV FOX 2 in the thirty (30) days prior to the commencement of this Sweepstakes is ineligible.

INTERNET: If for any reason, the Internet-related portion of this Sweepstakes is not capable of running as planned, including infection by computer virus, tampering, fraud, technical failure, or any other cause which corrupts or threatens the administration, security or integrity of the Sweepstakes. Sponsor reserves the right, in its sole discretion, to terminate or suspend the Sweepstakes or any portion of the Sweepstakes. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE CONTEST IS A VIOLATION OF THE CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.  Sponsor reserves the right to invalidate all website entries if the web site becomes technically corrupted.
Sweepstakes rules shall be governed and enforced pursuant to Missouri law, excluding choice of law provisions.
